WebTwister provides various Internet services, including web hosting and e-mail services. WebTwister has certain legal and ethical responsibilities regarding the use of its computer network and equipment involved in these services. While it is WebTwister's general policy to act as a neutral provider, WebTwister has certain specific ethical concerns regarding the use of its computers detailed below.

WebTwister reserves the right to suspend or cancel any customer's access to any or all services provided by WebTwister if and when WebTwister decides that the account has been inappropriately used.

Lawful Purpose

All services may be used for lawful purposes only.

Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or Local law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening, obscene, demeaning to others, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold us harmless from any claims resulting from the use of the service which damages the subscriber or any other party.

WebTwister's services are intended for the end user only. Customers are not authorized to sublease, subhost, or otherwise give away control of any portion of WebTwister resources in any way. Violators could face immediate cancellation.

Specific Unacceptable Use Policies

Unauthorized use of other people's accounts or computers

WebTwister will strongly react to any use or attempted use of an Internet account or computer without the owner's authorization. Such attempts include "social engineering" (tricking other people into releasing their passwords), password cracking, security hole scanning, etc.

Any unauthorized use of accounts or computers by a WebTwister customer, whether or not the attacked account or computer belongs to WebTwister, will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal action, according to the severity of the attack.

Commercial advertisements with e-mail

Unsolicited commercial advertisements are not allowed in e-mail, and will likely result in a suspension or cancellation.

Commercial advertisements are unwelcome in most Usenet discussion groups and on most mailing lists. Inappropriate posting may result in account suspension or cancellation. See the newsgroup or mailing list's charter for whether advertising is allowed or not. "Spamming" or sending a message to many different off-topic newsgroups, is particularly unethical and will be treated as such.

Sending a message, especially an advertisement, to more than five or six recipients, is by itself spamming unless the individuals have specifically requested to be added to a mailing list on topic. E-mail is a person-to-person medium, not a broadcast medium.

Abuse of Internet Traffic and Web Storage

The intention of WebTwister services is to provide space to serve web documents, not an offsite storage area for electronic files. All web pages (html) must be 'linked' with all files (gif, jpg, exe, etc.) stored on WebTwister servers. Web sites that are found to contain no html documents or a number of unlinked files are subject to warning, suspension or cancellation at the discretion of WebTwister management.

WebTwister will not host music archive sites that violate any copyright laws in any file format. Any sites that are found to contain this content will be warned, suspended, or canceled at the discretion of WebTwister management.

Obscene, Offensive and/or Pornographic Materials

WebTwister expressly forbids use of WebTwister servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, or pornographic material, sex-related merchandising, or any other material which we deem to be objectionable, including, but not limited to, pornography, satanic materials, and any and all materials of an adult nature. This includes sites that may infer sexual content, or provide links to adult content elsewhere.

The designation of any materials as such described above is left entirely to the discretion of WebTwister management.

Other Forms Of Unacceptable Content or Conduct

WebTwister expressly forbids use of WebTwister servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way any of the following types of content:

• Sites that promote any sort of illegal activity or content that may damage WebTwister servers, or any other server on the Internet - as well as links to any such materials;
• Sites that promote or sell bulk email services of any kind;
• Any sort of pirated software;
• Any sort of hacker programs or archives;
• Warez Sites;
• IRC Bots; and/or
• MP3 files, if being illegally distributed.

CGI Scripts And Chat Rooms

Each account comes with its own cgi-bin directory for the storage and deployment of CGI/Perl scripts. Users are free to use CGI scripts as they wish, but WebTwister reserves the right to disable - without warning - any CGI script we believe might adversely affect normal server operation.

We normally do not allow clients to install their own chat rooms; instead, we encourage users to link to offsite chat rooms, many of which are freely available elsewhere on the Internet.

Payment Policies

All accounts are set up on a prepay basis. Setup fees are charged for all new accounts and major account changes and are nonrefundable. All pricing is guaranteed for the term of prepayment. WebTwister reserves the right to change prices at any time. Any cancellations or modification in services included in a Special invalidates the Special price.

Payment is due each anniversary month or period following the date the account was established. Credit card orders that are on a 'month-to-month, 'quarterly', and 'yearly' basis will be charged automatically to the card number on file. If for any reason the card does not clear with the bank on three attempts, the account is subject to suspension. Any account not brought current within a week of e-mail notice or exceeding this time frame in any way is subject to suspension. Service fees do accrue during any period of suspension.

No bills or invoices will be sent by regular mail. Invoices for those customers who pay by check will be sent via mail 1 week before payment is due. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies WebTwister in writing a request for termination of services. Checks returned unpaid (NSF) will be assessed a $20 charge. All payment is in US currency.

Cancellation

WebTwister reserves the right to cancel service at any time. All fees paid in advance of cancellation will be prorated and paid by WebTwister if WebTwister institutes its right of cancellation. If cancellation is caused by customers' violation of these policies, then no refund is due. Customers can cancel service any time and be refunded any amount exceeding the prepayment current month. Due to security concerns, account cancellations ARE NOT accepted via e-mail or telephone. All account cancellations MUST be done in writing via US mail or fax with a valid signature of the primary contact of the account, account name, and reason for cancellation. If payment was made by check, the zip/postal code of the primary contact must be included. Payment will be made by company check within 30-60 days of receipt of cancellation or credit card return. The account will be canceled at the end of the current billing period, unless a date of cancellation is specified.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold WebTwister and its related companies and individuals entirely harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's asserted against WebTwister, its agents, its customers, officers and employees, that may arise or result from any services provided or performed or agreed to be performed or any product sold by customer, its officers and employees or assigns. Customer agrees to defend, indemnify, and hold harmless WebTwister against liabilities arising out of : (1) any injury to person or property caused by any products sold or otherwise distributed in connection with WebTwister server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) defective products sold to customer from WebTwister's server.

Disclaimer

WebTwister will not be responsible for any damages your business may suffer. WebTwister makes no warranties of any kind, expressed or implied for services we provide. WebTwister disclaims any warranty or merchant ability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by WebTwister and its employees. WebTwister reserves the right to revise its policies at any time.
